The 186 ENS (Employer Nominated Scheme) Visa

The 186 visa allows employers to sponsor or assist employees on a 457 visa to follow a pathway towards permanent residence while remaining in Australia.

There are 3 eligibility pathways for the 186 visa:

•    the Temporary Residence Transition stream

•    the Direct Entry stream

•    the Agreement stream.

All of these paths will generally require that you:

•    have been nominated by an approved Australian employer
•    are younger than 50 years of age, unless you are exempt
•    meet the skills, qualifications and English language requirements, unless you are exempt
•    apply under the stream for which you were nominated.

The Temporary Residence Transition Stream

This pathway applies to people already holding a 457 visa and who have worked for two years, at the same time as holding a subclass 457 visa, in the same occupation with their nominating employer.

That employer will need to have lodged a valid nomination under the “Temporary Residence Transition stream” and confirm that they now wish to offer the overseas employee concerned a permanent position in that occupation.

The Direct Entry Stream:

This typically covers people who have been nominated by their employer under the Direct Entry stream

People who have never, or only briefly, worked in Australia ortemporary residents who do not qualify for the Temporary Residence Transition stream also apply here.

The Agreement Stream

This category covers people sponsored by an employer through what’s called a “labour agreement”.
